This Privacy Policy (“Policy”) describes how we collect, store, and use your personal information through our website(s) and otherwise, including, without limitation, www.bullion.com (collectively, the “Services”).   

By shopping and making purchases through our Services, you are agreeing to the terms contained in this Privacy Policy.   

The terms “Bullion.com,” “we,” “us” and “our,” as well as similar terms, in this Policy refer to Bullion.com, LLC.

THIS POLICY IS SUBJECT, UNDER THE HEADING “CHANGES TO THIS POLICY,” TO CHANGE BY US IN OUR DISCRETION. 

WHAT THIS POLICY DOES

This Policy describes the following matters: (1) the personal information that we collect; (2) how we collect the personal information; (3) how we use the personal information; (4) how we may disclose your personal information; and (5) how we protect your personal information.  It also describes certain rights that some or all of our users may have with respect to their personal information and provides other relevant information, including, without limitation, information about our ability to change this Policy and how you can ask questions about this Policy. 

WHAT INFORMATION WE COLLECT

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with our users and/or their households.  That information is referred to in this Policy as “personal information.” 

We may also collect information other than personal information, which consists of information that cannot be associated or linked with our users and/or their households.  That information is referred to in this Policy as “non-personal information.”   

If personal information and non-personal information are combined in a manner so that the combined information can be associated or linked with a user or the user’s household, we treat the combined information as personal information. 

We may collect, share, and use data that has been aggregated, such as statistical data. Aggregated data may be derived from personal information but is not treated as personal information because it does not reveal your identity directly or indirectly.    

WHAT KINDS OF INFORMATION WE COLLECT

The personal information that we collect may include the following different kinds of personal information: 

  • identifiers, such as your first name, last name, alias, username or similar unique personal identifier, account name, online identifier and/or date of birth; 
  • contact information, such as your billing address, delivery address, email address and telephone number; 
  • financial information, such as your bank account and routing numbers, credit or debit card information, payment details, or other payment information; 
  • professional or employment information; 
  • profile data, such as your username, password, purchase or product preferences, feedback, and survey responses; 
  • network activity information, such as internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other device technology on the device; 
  • commercial data, such as order amount, details about your purchased products, your payments, and other details about purchased products; 
  • details of products you have purchased from us in the past; 
  • usage data; 
  • marketing and communication information, such as marketing campaign data, click-throughs, your preferences and consent in receiving marketing from us and our third parties, and your communication preferences; and 
  • inference data. 

HOW LONG WE KEEP YOUR INFORMATION.

We only keep personal information for the period reasonably necessary to fulfill the purpose for which we collected the personal information.  That includes any period that we need the personal information to satisfy any accounting, legal, regulatory, reporting, and/or tax requirements and may include a longer period if there is a pending customer complaint or dispute related to you. 

There are a number of factors that we consider in determining the period that we keep your personal information, including, among other factors, the amount, nature, and sensitivity of the personal information, the purposes for which the personal information was collected, applicable accounting, legal, regulatory, reporting and/or tax requirements, the possible risks of inappropriate disclosure or use and the magnitude thereof and any alternatives to accomplish the purposes for which the information was collected. 

WHAT IF YOU DO NOT PROVIDE INFORMATION

If you do not provide personal information that we need to comply with accounting, legal, regulatory, reporting, and/or tax requirements or that are required for your purchase, we may not be able to fulfill your purchase order and we may cancel your purchase order.  We will notify you of the cancelation of your purchase order. 

WHAT ABOUT THIRD PARTY INFORMATION

Our Services may include links and plugins to third-party websites.  We do not control those third-party websites and we are not responsible for any information that those third-party websites may collect, store, or use if you access them.  Those third-party websites may have their own policies on the collection, the disclosure and the use of personal information and you should review those policies. 

WHAT ABOUT CHILDREN

Our Services are intended for use by adults and are not intended for individuals under the age of 18. 

If you are under the age of 13, you are not authorized to provide us personal information and, if you are the parent or the guardian of a person under the age of 13 and you believe that such person has provided personal information, you should contact us at the email address or the telephone number in this Policy to have such information deleted. 

HOW WE COLLECT PERSONAL INFORMATION

General.  We may collect personal information in a number of different ways.    

Information Collected From You.  We may collect personal information that you voluntarily provide to us.  That personal information includes, without limitation, the following information: (a) information that you provide in creating a user account with us; (b) information that you provide in placing an order with or purchasing products from, us; (c) using the chat feature or other interactive features of our Services; (d) calling, emailing or otherwise communicating with us; and (e) otherwise interacting with us. 

Information From Using Our Services.  We may collect personal information as part of your interaction with us.  Like most websites, our website(s) receive and store personal information related to your interactions.  That personal information includes, without limitation, addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data and, when you interact with us through a mobile device may include, without limitation, device ID, location data, IP address, and device type.  

If you prefer, you can adjust the security settings on your web browser and your mobile device. 

COOKIES AND TRACKING TECHNOLOGIES. Like most websites, we use cookies, small files that we or our service provider transfer to your computer’s hard drive through your web browser, to understand better how you use our Services.   The cookies enable us or our service provider to recognize your browser and to remember certain information about you.   

If you prefer, you can adjust your web browser to notify you when a cookie is sent or to turn off cookies; however, such adjustments may result in the Services not functioning properly. 

INFORMATION FROM THIRD PARTIES.  We may collect personal information from third parties, including, without limitation, the following third parties: (a) third-party service providers; (b) third-party advertising providers; and (c) Google Analytics and Google Analytics Advertising Features, particularly Remarketing with Google Analytics.   

The collection, the use, and storage of such personal information is governed by the privacy policies of such third parties, which should be listed on their websites. In addition, those third parties may use their own cookies and other tracking technologies, and those third-party providers may otherwise collect, store, and use personal information in a manner inconsistent with this Policy. 

Your Browser Settings.  Some web browsers have a “Do Not Track” feature intended to signal websites that the user does not want the user’s online activity tracked.  Our Services do not currently respond to those signals and third-party websites from which we obtain information also may not respond to those signals. 

HOW WE USE YOUR PERSONAL INFORMATION.   

We will only use personal information in accordance with applicable law.  Our most common uses of personal information are: 

  • to make sales to you; 
  • otherwise to carry out the contractual relationship with you; 
  • to comply with our accounting, legal, regulatory, and/or tax obligations; and 
  • in a manner necessary for our legitimate interests or legitimate third-party interests where your interests and fundamental rights do not override those legitimate interests. 

A legitimate interest is an interest that is a foundation of conducting and managing our business to enable us to give you the best products and the best services and the best and most secure experience. We strive to consider and to balance any potential impact on you, positive and negative, and your rights before we process your personal information for our legitimate interests. We do not use your personal information for activities where our interests are overridden by the impact on you (unless we have your consent or we are required or permitted to do by law). HOW WE DISCLOSE PERSONAL INFORMATION

We only disclose your personal information in the manner described in this Policy.  That may include disclosure of personal information to third parties that we use in the performance of the Services.   

We may disclose your personal information in the following manners: 

Information You Instruct Us to Disclose.  If you instruct us to share your personal information, in response to an option on our website(s) or otherwise, your personal information may be disclosed to third parties. 

Information Disclosed to Affiliates.  We may disclose your personal information to our parent entity and our affiliated entities, some of which provide services and other support to us, and which need to know that personal information to provide those services and that support.  We may also disclose your personal information to their managers, officers, employees and agents that need to know such information in connection with such services and such support. 

Information Disclosed to Service Providers.  We may use third parties to provide business-related services and may disclose to those third parties private information that is necessary for them to provide those business-related services.  Such business services may include, without limitation, accounting and audit services, analytics services, collection services, compliance services, document management services, communications services, hosting services, legal services, logistics services, marketing services, quality control services and software and website development. 

Those third parties may only use the private information to provide those business-related services and may not disclose or sell the private information.  

Information Disclosed in Business Transactions. We may engage in business transactions with third parties, such as, for example, acquisitions and dispositions, consolidations and mergers, equity issuances, financings, joint ventures and licensing transactions.  We may disclose your personal information in connection with the analysis, the negotiation and/or the consummation of such business transactions. 

Information Disclosed under Legal and Regulatory Requirements. We may disclose your personal information that we are required to disclose pursuant to applicable law or regulations, such as, for example, (a) in response to legal and regulatory requirements, (b) in response to a subpoena or other legal process, (c) in response to requests by governmental entities, including, without limitation, law enforcement authorities, and (d) in response to investigations of actual or suspected criminal activity. 

In the period since our formation, we have shared the following information with affiliated and internal personnel and with third party services providers: (a) identifiers; (b) contact information; (c) financial information; (d) professional and employment information; (e) professional and employment information; (f) profile data; (f) internet and other electronic network activity information; (g) usage data; (h) marketing and communications information; and (i) inference data. 

SHARING AND SALE OF PERSONAL INFORMATION

General.  We have not in the past sold and will not in the future sell personal information of our users; we have shared and may share personal information with our third party service providers that affect the ads about our products and services that you see as you browse the Internet. 

"Sharing" is defined under California privacy law as "renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's Personal Information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged." This sharing enables these third party service providers to use their own cookies or tracking technologies to track your online activities and purchases in order to deliver targeted advertising based on your interests. 

You can opt out of sharing through the “Do Not Share My Personal Information” link and, additionally, if supported by your browser, you can turn on the Global Privacy Control (GPC) to opt out of the sharing of your personal information. You may learn more about the GPC at its website, https://globalprivacycontrol.org/

We have no knowledge of any sales or sharing of personal information of individuals under the age of 16 years. 

We note that text messaging originator opt-in data and consent is not shared with any third parties. 

Marketing and Promotional Communications; Opt-Out. By creating a user account and using the Services, you are agreeing to receive periodic marketing and promotional communications from us.  You may opt out of receiving such communications at any time by following the “unsubscribe” instructions in an email or by contacting us.  Any decision by you to opt out of receiving such communications will not apply to other communications, but particularly informational and operational communications.   

You may continue to receive such marketing and promotional communications for a short period of time while we process your request. 

If you are located in the European Economic Area (“EEA”) or the United Kingdom, you may have special rights that are discussed below under the heading, “EEA and United Kingdom Privacy Rights.” 

HOW WE PROTECT YOUR PERSONAL INFORMATION.

We transmit information by industry-standard secure server (SSL), which creates the secure and encrypted https:// website address for our important pages, such as the pages for your user account information and for your checkout. When you see the https:// website address, you know the information you are inputting is protected and secure using the SSL.  

We also comply with payment card industry data security standards that require merchants to implement security measures for credit card information. 

We have implemented and maintain generally accepted industry standards to protect against the unauthorized access, destruction, disclosure, modification or use of your personal information both during transmission and once we receive it.  

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. 

ABILITY TO CORRECT AND UPDATE INFORMATION

We want your information to be accurate and complete and, indeed, you have a legal obligation under the User Agreement to provide accurate and complete information and to keep that information accurate and complete. 

You may confirm the accuracy and the completeness of, and you may make updates and other changes to, your information by contacting us. 

SPECIAL CALIFORNIA PRIVACY RIGHTS.

The California Consumer Privacy Act, as amended (“CCPA”), provides specific rights to California residents with respect to their personal information. It does not apply to persons other than California residents. 

If you are a California resident, this section under the heading “SPECIAL CALIFORNIA PRIVACY RIGHTS” describes your rights under the CCPA and how you may exercise those rights. 

Right to Know.  Upon the verification of your identity, you may exercise, no more than twice in any 12 month period your right to know what personal information that we have collected about you in the immediately preceding 12 month period, including the categories of personal information, the categories of sources from which the personal information was collected, the business or commercial purpose for we collected, sold or shared the personal information, the categories of third parties to whom we have disclosed personal information and the specific pieces of personal information we have collected. 

Right to Delete.  You have the right to request that we delete your personal information that we have collected, subject to certain exceptions under the CCPA. 

Right to Correct. You have the right to correct inaccurate personal information about you that we maintain. 

Right to Opt-Out of Sale and Sharing.  You have the right to opt out of the sale and the sharing of your personal information. We do not sell personal information. 

Right to Limit Disclosure or Use of Sensitive Personal Information.  You have the right to request that we not disclose or use sensitive personal information (within the meaning of the CCPA). 

Right to Non-Discrimination.  Unless permitted under applicable law, we may not discriminate against you for exercising any of your rights under the CCPA or other applicable law, including, without limitation, (a) by denying you goods or services; (b) by charging you different prices or rates for goods and services, including, without limitation, by using discounts or other benefits or by imposing penalties; (c) by providing you a different quality of goods and services; and/or (d) by suggesting that you will receive a different price or rate for goods or services or a different quality of goods and services.

You can opt-out of having your personal information shared by clicking on the “Do Not Share My Personal Information” link on our website(s). 

These rights may only be exercised by California consumers and business contacts. Only you or a person that you authorize to act on your behalf may make a verifiable consumer request related to your personal information. 

Authorizing an Agent. Except where you have provided an agent with a power of attorney pursuant to Section 4000 to Section 4465 of the California Probate Code, to use an authorized agent, you are required (a) to provide the agent with signed written permission clearly describing the agent’s authority to make a request on your behalf, (b) to verify your own identity and (c) to confirm directly that you have provided the authorized agent permission to submit the request. We may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that the agent has been authorized to act on your behalf. 

Verification of Your Request.  To be a verifiable consumer request, the request initiated by you or your authorized agent must: (a) include your full legal name, email address and phone number, which we will need to contact you in order to verify that you are the persons about whom we collected personal information or any authorized agent of such person; and (b) describe your request in sufficient detail for us properly to understand, to evaluate and to respond to your request. 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or your authority to make the request and to confirm the personal information relates to you. Making a verifiable consumer request does not require you to create a user account with us.  

One of our representatives will contact you in order to verify your identity. You may need to provide us additional information in order to verify your request and, depending on the nature of the request, we may require additional actions be taken for verification, including, without limitation, providing a signed declaration under penalty of perjury that you are the user whose personal information is the subject of the request. We will only use this information to verify the requesting person’s identity or authority to make the request. 

Exceptions.    

There are exceptions to your rights under CCPA. For example, we cannot disclose or permit access to specific pieces of personal information if granting your request would present a certain level of risk to the security of the personal information at issue, your user account with us or the security of the website(s).  

We may deny your deletion request if retaining the information is necessary for us or our service providers and/or contractors: 

  • to complete the transaction for which we collected the personal information, to provide the goods or the services that you requested or to take actions reasonably anticipated within the context of our ongoing business relationship with you or otherwise to perform our contract with you; 
  • to detect security incidents, to protect against deceptive, fraudulent, illegal or malicious conduct or to prosecute the people responsible for such activities; 
  • to debug products to identify and to repair errors that impair existing intended functionality; 
  • to exercise free speech, to ensure the right of another consumer to exercise such consumer’s free speech rights or to exercise another right provided for by law; 
  • to comply with the California Electronic Communications Privacy Act, as amended; 
  • to engage in peer-reviewed or public historical, scientific or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement if you previously provided informed consent; 
  • to enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; 
  • to comply with a legal obligation; and/or 
  • to make other internal, lawful uses that are compatible with the context in which you provided the information to us. 

Response Timing; Fees. We work to respond to a verifiable consumer request within 45 days of its receipt. If we need more time (up to 90 days), we will inform, in writing, you of the period of, and the reason for, the extension.  

We do not charge a fee to process or to respond to your verifiable consumer request, unless your request is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you the reason for that decision and we will provide you with a cost estimate before completing your request. 

Other California Privacy Rights.  California residents have the right to receive information that identifies any third party companies or individuals with which we have shared your personal information within the previous calendar year, as well as a description of the categories of personal information disclosed to that third party.  

You may obtain this information once a year and free of charge by contacting us as provided in this Policy. 

SPECIAL EEA AND UNITED KINGDOM PRIVACY RIGHTS

If you are located in the EEA or in the United Kingdom, you have specific rights with respect to your information. Those rights are not available to persons not located in the EEA or the United Kingdom. 

If you are located in the EEA or the United Kingdom, the section under the heading “SPECIAL EEA AND UNITED KINGDOM PRIVACY RIGHTS” describes your special rights and how you may exercise those rights. 

If this section is inconsistent with, or conflicts with, any other part of this Policy, this section will prevail.   

Marketing. We try to give you choices regarding the use of personal information, particularly with respect to advertising and marketing. 

Promotional Offers. We may use your identifiers, employment and contact information and technical, usage and profile data to form a view on what we think you may want or need or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you, a process that we call marketing. 

You will receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted-out of receiving those marketing communications. 

Third Party Marketing. We will get your express consent to opt-in before we share your personal information with any third party for marketing purposes. 

Opting-Out.  You can request us or third parties to stop sending you marketing communications at any time by following the opt-out links on any marketing communications sent to you or by contacting us at any time. 

A request by you to opt-out of receiving marketing communications will not apply to email or other communications that are of a non-promotional nature and that relate to a product/service subscribed for, product/service experience or other transactions. 

Change of Purpose.  We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purposes. If you want an explanation as to how the processing for the new purpose is compatible with the original purposes, please contact us. 

If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis that allows us to do so. 

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law. 

International Transfers.  Many of our external third parties are based outside the EEA and the United Kingdom so their processing of your personal information will involve a transfer of data outside the EEA and the United Kingdom. 

When we transfer your personal information to a third party that is based outside the EEA and the United Kingdom, we ensure a similar degree of protection is afforded to that personal information by ensuring at least one of the following safeguards is implemented:

Summary of Your Legal Rights and How to Exercise Them

  • Correction of Personal Information. You may request the correction of personal information that we hold about you. This request enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. 
  • Erasure of Your Personal Information. You may request erasure of your personal information. This request enables you to ask us to delete or to remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or to remove your personal information where you have successfully exercised your right to object to processing, where we may have processed your information data unlawfully or where we are required to erase your personal information to comply with local law. Please note that we may not always be able to comply with your request of erasure for specific legal reasons; we will notify you of such specific legal reasons, if applicable, at the time of your request. 
  • Object to Processing of Personal Information. You may object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation that makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your data which override your rights and freedoms. 
  • Request Restriction of Processing of Personal Information. You may request restriction of processing of your personal information.  This request enables you to ask us to suspend the processing of your personal information in the following scenarios: (a) you want us to establish the data's accuracy; (b) our use of the data is unlawful but you do not want us to erase it; (c) you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; and (d) you have objected to our use of your personal information but we need to verify whether we have overriding legitimate grounds to use it. 
  • Request Transfer of Personal Information.  You may request the transfer of your personal information to you or to a third party. We will provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format.
